TERMS & CONDITIONS OF VEHICLE RENTAL

These Terms & Conditions form the legally binding agreement (“Agreement”) between Prestige United Ventures Pty Ltd (“the Company”) and the driving instructor hiring the vehicle (“the Hirer”). By booking or taking possession of a rental vehicle, the Hirer acknowledges and agrees to all terms below.


1. Definitions

Company – Prestige United Ventures Pty Ltd, including its authorised staff and agents.
Hirer – The driving instructor named in the Rental Agreement.
Vehicle – The dual-control motor vehicle supplied, including keys, fuel card if provided, accessories, registration plates, tools and equipment.
Authorised Driver – The Hirer or any additional driver approved in writing by the Company.
Rental Period – The duration from pick-up until return of the Vehicle.


2. Service Eligibility

  1. This rental service is strictly available only to qualified and licensed driving instructors in Australia.

  2. The Hirer must hold a current and valid Australian driver’s licence.

  3. Learner drivers are not permitted to operate the Vehicle without the Hirer present and in full control.

  4. The Vehicle must not be sub-hired, transferred, or loaned to any person without express written approval from the Company.


3. Authorised Use of the Vehicle

The Vehicle may be used only for:

  • Paid driving lessons

  • Teaching students under supervision

  • Instructor business use (e.g., travel between lessons)

  • Reasonable incidental personal use

The Vehicle must not be used for:

  • Any illegal purpose

  • Rideshare or taxi services (Uber, DiDi, etc.)

  • Off-road driving, beaches, unformed tracks, floodwaters

  • Racing, performance testing, burnout activities, or dangerous driving

  • Transporting unauthorised passengers or more students than legally permitted

  • Smoking or carrying animals (unless in approved carriers)

The Company may refuse rental or terminate an Agreement if unsafe or inappropriate use is suspected.


4. Vehicle Condition, Care & Responsibilities

  1. The Hirer must take proper care of the Vehicle at all times, keep it secure when unattended, and ensure windows are closed when parked.

  2. The Hirer must use the correct fuel type and follow all mechanical instructions supplied.

  3. The Hirer must check tyres, lights, mirrors, seatbelts, and the functionality of dual controls daily or before each lesson.

  4. The dual-control system must never be modified, adjusted, removed, or tampered with by the Hirer.

  5. The Company may conduct inspections at any time.


5. Damage, Loss & Liability

  1. The Hirer is liable for all loss or damage to:

    • The Vehicle

    • Any third-party vehicle or property

    • Accessories (mirrors, cameras, signage, dual controls, etc.)

  2. Liability is limited only to the Insurance Excess when:

    • The Hirer complies with all Terms & Conditions

    • The Vehicle is used responsibly and legally

  3. The Hirer becomes fully liable (no excess limit) if:

    • Any term of this Agreement is breached

    • The Vehicle is driven under the influence of alcohol or drugs

    • The Vehicle is used recklessly, carelessly, or illegally

    • An unauthorised driver operates the Vehicle

    • Floodwater or off-road damage occurs

    • The incident is not reported promptly

  4. The Hirer agrees to pay all costs associated with towing, storage, repair, loss of use, and diminished value if responsible for damage.


6. Accidents & Incidents

If the Vehicle is involved in an accident, theft or damage incident, the Hirer must:

  1. Stop immediately and render assistance where required by law.

  2. Notify police if:

    • Anyone is injured

    • A vehicle was towed

    • A third party refuses to exchange details

    • Required by relevant road authority

  3. Notify the Company as soon as possible.

  4. Provide full details including:

    • Names, licence numbers and contacts for all involved

    • Photos of the scene and damage

    • Third-party insurance details

  5. Not admit liability or negotiate with third parties.

  6. Submit any requested written statement or incident report.


7. Mechanical Breakdown

  1. If the Vehicle suffers a mechanical failure not caused by misuse, the Company will provide roadside assistance at no cost.

  2. Issues caused by the Hirer's actions (e.g., incorrect fuel, flat battery due to negligence, tyre damage) will incur call-out fees.

  3. The Company may offer a replacement dual-control vehicle if available.

  4. All Terms & Conditions apply to any replacement vehicle.


8. Rental Charges & Payment Terms

The Hirer agrees to pay the Company:

  • Daily rental charges for the entire Rental Period

  • A bond or security deposit (if applicable)

  • Insurance excess (when required)

  • Fuel refill charges

  • Late return fees

  • Cleaning or detailing fees for smoke, spills, odours or stains

  • Replacement of keys or key-fobs

  • Windscreen, tyre or cosmetic damage

  • Fees for roadside assistance where the Hirer is at fault

  • Loss or damage charges not covered by insurance

  • Administrative fees for tolls, fines and recovery costs

The Company may deduct any amount owed from the Hirer’s stored payment method.


9. Tolls, Traffic Infringements & Fines

  1. The Hirer is fully responsible for all toll road usage during the Rental Period.

  2. The Company may pass through charges or process tolls directly against the Hirer’s payment method.

  3. The Hirer is responsible for all:

    • Speeding fines

    • Parking fines

    • Red-light offences

    • Traffic camera infringements

    • Seatbelt and mobile phone offences

  4. An administrative fee may apply to each notice processed by the Company.


10. Fuel Policy

  1. The Vehicle must be returned with the same fuel level as supplied.

  2. If the Hirer returns the Vehicle with less fuel, a fuel charge of $3.50 per litre will apply.

  3. Incorrect fuel use may result in full liability for repair and recovery.


11. Returning the Vehicle

  1. The Vehicle must be returned on the date and time specified in the Rental Agreement.

  2. Extensions must be approved in advance and may be refused depending on availability.

  3. The Vehicle must be returned to the agreed location.

  4. Late returns may incur:

    • Additional daily rental charges

    • Late fees

    • Loss-of-use charges

  5. The Vehicle must be returned in clean condition.


12. GPS Tracking & Telematics

The Hirer acknowledges that:

  1. Vehicles may be equipped with GPS tracking, dash cameras, or telematics systems.

  2. The Company may use this data for:

    • Security and theft prevention

    • Verifying compliance with rental terms

    • Investigating accidents

    • Maintenance and diagnostics

  3. Tampering with tracking or telematics devices is strictly prohibited and may result in full liability.


13. Termination of Agreement

The Company may immediately terminate the Agreement if:

  • The Hirer breaches any term

  • Unsafe or illegal use is detected

  • Payment fails or is reversed

  • False information was provided

The Hirer must return the Vehicle immediately upon notification.


14. Privacy Policy

The Company may collect and store information for:

  • Identification

  • Payment processing

  • Legal compliance

  • Insurance and incident handling

  • Operational and maintenance purposes

The Company will not sell or disclose personal information except where legally required or operationally necessary.


15. Governing Law

This Agreement is governed by the laws of the State or Territory where the rental was executed.
Any disputes will be handled under that jurisdiction.


16. Entire Agreement

These Terms & Conditions form the entire agreement.
No verbal statements or representations modify this Agreement unless confirmed in writing by the Company.
