Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Prestige Driving School - ABN 21 602 137 217.

Preconditions and Warranties

By booking a lesson with Prestige Driving School, the learner warrants that they:

• Hold a valid Australian driver licence (learner licence or above) or an equivalent overseas licence authorising them to drive on public roads (whether or not it is subject to additional conditions) in the state or territory where they intend to take lessons.
• Are at least 18 years old, or if under 18, have obtained consent from their parent or legal guardian. The Terms of Service bind both the learner and the consenting parent or legal guardian.

Relationship of the Parties

The learner acknowledges and agrees that:

• Prestige Driving School operates as a platform, facilitating connections between learner drivers and licensed driving instructors. While we ensure all instructors listed are qualified and licensed, it is the responsibility of learners to conduct their own due diligence when selecting an instructor.
• Instructors act as independent contractors, not employees of Prestige Driving School. Therefore, any agreement for driving instruction is directly between the learner and the instructor. 
• Prestige Driving School does not warrant the accuracy of information provided by instructors on the platform. While we strive to ensure quality and reliability, learners should verify instructor details to their satisfaction.
• Learners indemnify Prestige Driving School against any claims or damages arising from their use of the Service, including but not limited to, interactions with instructors.
• Learners accept full risk in relation to their personal and property safety and security in booking and taking a lesson with an instructor.

Payment Conditions

The learner acknowledges and agrees that:

• Single Lessons can be paid for either in cash or using a credit card (Visa, MasterCard, Amex only), with a 2.5% card processing fee applied to all card transactions.
• Lesson packages must be exclusively purchased either through our website or in-car, using a credit card (Visa, MasterCard, Amex) and also subject to a 2.5% card processing fee. Prestige Driving School disclaims all liability for large sums of cash given directly to instructors or for any amounts transferred into their personal bank accounts.
• Cash payments must be made directly to the instructor at the start of the session.
  
  
  

Fidelity

The learner driver agrees to use the Service in good faith and not to do or omit to do anything that damages or may damage Prestige Driving School’s reputation or business. This includes, but is not limited to, circumventing Prestige Driving School by directly booking lessons with instructors associated with the Service. Such actions are strictly prohibited, and Prestige Driving School reserves the right to hold the learner driver liable for any damages, liabilities, or losses resulting from these unauthorised dealings.

Provision of Lessons

The learner acknowledges and agrees that:

• All on-road lessons commence and conclude at the designated pick-up location, as mutually agreed upon during the booking process.
• A standard on-road lesson encompasses one hour, inclusive of both briefing and/or debriefing periods.
• Students are required to wear suitable footwear throughout lessons, with flat-soled, enclosed shoes recommended for secure fit and optimal pedal control.
• It's important to be prepared for your lesson 10 minutes before the agreed start time. Should you fail to arrive as scheduled, the instructor will wait for up to 15 minutes, during which any delay will be subtracted from your lesson's total duration. Arrivals beyond this 15-minute window give the instructor the discretion to cancel the lesson, in which case the full lesson fee will still be applicable.
• We strive to start all lessons on time and with the designated instructor. However, we cannot be held accountable for delays or instructor changes caused by unforeseen circumstances. Should such a situation affect the start time of your lesson, we are committed to providing the full lesson duration whenever possible. If delivering the full scheduled time isn't feasible, we will arrange for the lesson to be rescheduled to a more convenient time.
• The learner is required to follow the instructor's instructions and directions at all times, both before and during the lesson.
• Instructors reserve the right to terminate a lesson if:
  a. The learner engages in behaviour deemed reckless by your instructor, or
  b. The learner does not follow the instructions or directions given by the instructor, either before or during the lesson, or
  c. The learner fails to meet specific conditions of their license, such as the requirement to wear glasses or contacts.
  Should a lesson be terminated for any of the reasons mentioned above, the learner will be obligated to pay for the full cost of the lesson.
• Driving lessons in your vehicle are permitted after you have completed at least one full lesson with us to assess your driving skills. Following this assessment, if your instructor agrees to conduct lessons in your vehicle, it is your responsibility to ensure that your car is insured with both compulsory third-party and comprehensive insurance. We, along with our driving instructors, will not be held accountable for any traffic violations or accidents that may occur while conducting driving lessons in your vehicle.
• All bookings are contingent upon availability and must adhere to the Prestige Driving School Cancellation Policy for any cancellations.

Provision of Driving Tests

The learner acknowledges and agrees that:

• The instructor will present the learner to Service NSW for their driving test only if they determine that the learner is sufficiently prepared and demonstrates the necessary safety and competence to undertake the test. Competency is determined solely at the discretion of the instructor, based on their professional assessment of the learner’s driving skills and readiness for the test.
• The learner becomes eligible for our First Go Guarantee once the instructor assesses them as competent to undertake their driving test. To utilise this guarantee, the learner must:
  a. Schedule their driving test within 4 weeks of their last lesson with us,
  b. Use one of our instructor’s cars for the test, and
  c. Claim their complimentary lesson within 30 days of completing their driving test.
  Please note, Prestige Driving School cannot be held responsible for the outcome of any driving test conducted under different circumstances.
• The First Go Guarantee applies exclusively to the learner's initial driving test attempt and does not extend to any subsequent tests.
• Our driving instructors and Prestige Driving School will not be held liable if the driving test is cancelled due to any errors in the learner's log book, except for those entries completed by us. The logbook includes detailed instructions on how to fill it out accurately. It is the learner's responsibility to ensure their log book is correctly completed and complies with all required standards before their driving test appointment.
• If a learner is presented to Service NSW for a driving test by one of our instructors and the test is cancelled for reasons not attributable to Prestige Driving School, including but not limited to the following, they will be required to pay the Driving Test Package fee in full:
  a. Errors or omissions in their logbook, for which they are fully responsible;
  b. Booking an incorrect type of test, such as a Hazard Perception Test instead of a Driving Test;
  c. Discrepancies in the scheduled test time or location; or
  d. Cancellation or rescheduling by Service NSW due to staff shortages or other unforeseen circumstances.

Purchase of Goods and Services

The learner acknowledges and agrees that:

• Prestige Driving School reserves the right to amend pricing errors at any time.
• Prestige Driving School reserves the right to refuse service to any individual at its sole discretion and without obligation to provide a reason.
• If you require an extension for your package, you must submit your request in writing before the package's expiry date. Extensions are granted on a case-by-case basis and at the sole discretion of Prestige Driving School.
• Expired vouchers will be converted into non-refundable credit, which can be used to repurchase services at the prevailing rates at the time of redemption.
• All unused prepaid credit will expire after three years of user inactivity. Once expired, the credit cannot be reinstated under any circumstances.
• Discounts and free lessons provided by us cannot be transferred to another person or redeemed for cash.

Zero Tolerance Policy for Abusive Behaviour

We maintain a zero-tolerance policy for any form of abusive behaviour towards our staff. Such behaviour will result in an immediate and permanent ban from using the Service. This policy is in place to ensure a safe and respectful environment for all.

Modifications to Services and Prices

• Prestige Driving School reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
• Prices of all Services are subject to change with or without notice.
• Prestige Driving School shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
