Terms of Service

By using this website ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service") with Prestige Driving School - ABN 21 602 137 217.

These Terms may be varied from time to time and will be updated on the website. You will be bound by the Terms you accept at the time of booking your lesson. If you book more than one lesson at the same time, the terms and conditions applicable at the time of booking will apply to each lesson booked at that time.

1. Fees and cancellations/rescheduled bookings
1.1 You must give more than 24 hours notice to cancel a lesson booking, or your lesson fee will be payable.
1.2 You must give more than 24 hours notice to reschedule a lesson booking. The lesson fee will be payable if a booking is rescheduled by providing less than 24 hours notice.
1.3 We reserve the right to reschedule a lesson subject to the provision of reasonable notice.
1.4 We reserve the right to refuse to provide a lesson where you are unfit to operate a vehicle or suspected to be under the influence of drugs or alcohol as reasonably determined by us. If such circumstances arise, your lesson fee will be payable.

2. Payment Conditions
2.1 Payment must be made at the beginning of the session directly to the instructor.
2.2 Accepted payment methods for Single Lessons are cash or credit card (Visa, MasterCard, Amex Only with 2.5% Surcharge).
2.3 Packages must be strictly purchased on our website or in-car using a credit card (Visa, MasterCard, Amex Only with 2.5% Surcharge). Prestige Driving School accepts no responsibility whatsoever for large sums of cash paid upfront to an instructor or transferred to their personal bank accounts.

3. Provision of Lessons
3.1 You must hold a current Australian driving licence (Class C LRN or C) or equivalent overseas licence and carry it with you during a lesson.
3.2 On-road lessons commence and end at the pre-determined pick-up point, determined at the time of booking the lesson.
3.3 The duration of a standard on-road lesson is one hour, which includes briefing and/or debriefing time.
3.4 Proper footwear must be worn during the lesson. A flat, enclosed and secure shoe is recommended.
3.5 You will need to be ready to begin the lesson 10 minutes before the agreed time. If you do not turn up at the agreed time for your lesson, your instructor will wait 15 minutes and may deduct this from the total lesson time at the instructor's reasonable discretion. If you turn up outside these times, your instructor may, in his/her reasonable discretion, choose not to proceed with the lesson, and in such circumstances, you will be liable for the cost of the lesson.
3.6 While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control that may delay the start time or result in a change of instructor. If circumstances beyond our control have delayed the start time of your lesson, we will offer you the full lesson time, or if that is not possible, we will offer you a lesson at another time.
3.7 You must comply with the instructions or directions of your instructor at all times, before or during a lesson.
3.8 We reserve the right to terminate a lesson if:
a. you engage in any behaviour that your instructor determines is reckless; or
b. you fail to comply with the instructions or directions of your instructor before or during a lesson; or
c. you fail to comply with any special conditions on your license, i.e. wearing of glasses/contacts
If a lesson is terminated under the circumstances listed above, you will be required to pay the full cost of the terminated lesson.
3.9 Neither our driving instructors nor we accept any liability whatsoever for personal property left in any instructor-supplied vehicle.
3.10 Driving lessons can only take place in your vehicle if you have at least one full lesson with us to assess your driving. After this assessment, if your instructor agrees to provide lessons in your car, you warrant that your car is covered by compulsory third-party and comprehensive insurance. Neither our driving instructors nor we accept any responsibility whatsoever for traffic infringements or accidents resulting from a learner having driving lessons in their car.

4. Driving Test
4.1 Your instructor will only present you to Service NSW if they deem you safe to sit for your driving test.
4.2 You can take advantage of our First Go Guarantee if and when you are deemed competent by your instructor to sit your driving test. You must sit your driving test within the next 6 weeks following your last driving lesson with us, use one of our cars for your driving test and take your free lesson within 30 days of your driving test. We do not accept any responsibility for the outcome of any driving test otherwise.
4.3 Our First Go Guarantee only applies to the very first driving test you take. Subsequent driving test(s) do not qualify for the First Go Guarantee.
4.4 Neither our driving instructors nor we accept any responsibility whatsoever if your driving test is cancelled due to any error(s) in your log book unless it is an entry we have made. Instructions on how to fill in the log book properly are presented in your log book, so please use due diligence to make sure your log book meets the necessary requirements before attending your driving test.
4.5 If you are presented to Service NSW for a driving test by one of our instructors, but your test is cancelled due to any error(s), omission(s) or fault(s) not caused by us, including but not limited to the items listed below, your Driving Test Package fee will be payable in full.
a. Any error(s) or omission(s) in your log book (you are fully responsible regarding your log book as per clause 4.4)
b. You have booked a different test by mistake (e.g. Hazard Perception Test instead of Driving Test)
c. Your test is at a different time or location
d. Service NSW's inability to take your test due to staff shortages or any other situation

5. Gift Vouchers
5.1 Gift vouchers are redeemable at locations across NSW where Prestige Driving School provides service.
5.2 Gift vouchers purchased at full price are valid for 36 months from the date of purchase. 
5.3 Gift vouchers purchased at a discounted price (packages) are valid for 6 months from the date of purchase, except for those purchased between 15/11/2021 and 01/05/2022, which are valid for 12 months from the date of purchase. 
5.4 If you need an extension for your gift voucher, you must send us your request in writing BEFORE your gift voucher expires. Extensions are granted in a case-by-case scenario and at our discretion. Expired vouchers CAN NOT be extended.
5.5 All bookings are subject to availability, and cancellations can only be made in line with Prestige Driving School Cancellation Policy.
5.6 Gift vouchers are non-refundable, not redeemable for cash and cannot be exchanged.

6. Promotions, Discounts & Free tuition
Any discounts or free lessons are not transferrable or redeemable for cash.

7. Purchase of Goods and Services
7.1 Prices and availability of our services are subject to change at any time without notice. Prestige Driving School reserves the right to correct pricing errors at any time.
7.2 You warrant to Prestige Driving School that all information you give us through this site (including your name, contact and address details, and credit card details) are correct.
7.3 Prestige Driving School reserves the right to refuse service to anyone for any reason.
7.4 The availability of services may change from time to time due to unforeseen problems or unexpected demand. Prestige Driving School is not liable for any loss or damage whatsoever arising from failure to deliver or delay in delivery of any services.
7.5 Packages are valid for 6 months from the date of purchase except for those purchased between 15/11/2021 and 01/05/2022, which are valid for 12 months from the date of purchase. DUE TO THE COMPLEX NATURE OF OUR BUSINESS, EXPIRED LESSONS CANNOT BE DELIVERED OR REFUNDED.
7.6 If you need an extension for your package, you must send us your request in writing BEFORE your package expires. Extensions are granted in a case-by-case scenario and at our discretion.

8. Copyright and Trademark
8.1 All the material on this website is subject to the copyright of Prestige Driving School. You must not reproduce or copy any of the material on this website or otherwise incorporate it into or store it on any other website.

9. Disclaimer
The information contained on this website is for general information purposes only. You must not rely on any statement contained on this website without taking specialist advice. While we endeavour to ensure the accuracy and completeness of the information contained on this website, we make no warranties and accept no responsibility for any loss or damage you may suffer as a result of your reliance on any part of it.

10. Access
Although we will do our best to provide constant, uninterrupted access to this website, we cannot and do not guarantee this. We accept no responsibility or liability for any interruption or delay.

11. Governing Law
The laws of New South Wales, Australia, govern these terms and conditions. You and we irrevocably submit to the exclusive jurisdiction of the courts of New South Wales.

Account Terms

This page contains the most current version of the Terms of Service.

• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
  
• You are responsible for all activity that occurs from your account.
  
• You agree that Prestige Driving School can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
  
• You must not post or submit false information to the Service.
  
• You are responsible for maintaining the security of your account and password. Prestige Driving School cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
  
• Prestige Driving School has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other Prestige Driving School service, for any reason.
  
• Violation of any of the terms or general conditions may result in the termination of your Account.
  
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, Prestige Driving School has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Prestige Driving School service. Such termination of the Service will result in the deactivation of your Account.
  

Cancellation Rates

• Less than 24 hours notice before the booking will forfeit the full booking fee.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at Prestige Driving School.

 

Modifications to Services and Prices

• Prestige Driving School reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  
• Prices of all Services are subject to change with or without notice.
  
• Prestige Driving School shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
  

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers can be transferred between clients.
• Purchases containing multiple vouchers can only be used by a single person and cannot be split between people.
• Vouchers are valid for 6 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by Prestige Driving School for payment processing.
  
• All fees and transactions are in Australian Dollars.
  

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
  
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by Prestige Driving School.
  
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Prestige Driving School customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
  
• You must not transmit any worms or viruses or any code of a destructive nature.
  
• You understand that Prestige Driving School uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
  
• Prestige Driving School does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
  
• You expressly understand and agree that Prestige Driving School shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Prestige Driving School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
  
• The failure of Prestige Driving School to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
  
• You expressly understand and agree that Prestige Driving School shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
